Please note this is the judgment against which an appeal has been filed by the Rajasthan High Court and not the order of the Rajasthan High Court itself. We will be carrying an analysis of the judgment soon, however I would like to point out that the Judgement seems to have been rendered under the wrong legislation i.e. it has been rendered under the Trade Marks Act, 1958, which was in fact repealed and replaced by the Trade Marks Act, 1999!!! Having said that I would also like to point out to the fact that the judgment has been rendered in a record time of just 2 years.
